Can I form an EU Inc today?
No. The EU Inc is a proposed regulation (COM(2026) 321, published 18 March 2026) that Parliament and Council are still negotiating. Political agreement is targeted for the end of 2026 and application from 2027. Nobody can register one today, and any service claiming otherwise is selling you something that does not exist.
Can I reserve my company name in advance?
No, and be careful with anyone who offers it. There is no register yet, so there is nothing that could hold a reservation and no one who can grant you priority. What you can do usefully today is check the name against existing EU trade marks — that is the same check the register will run automatically under Art. 13(7) of the draft.
Who will be allowed to use an EU Inc?
That is the main open question. The Commission draft (Art. 3(c)) allows formation by one or more natural or legal persons, with no sector or size limit. The Parliament rapporteur's draft report of 29 June 2026 would restrict it to startups using a numeric definition plus a list of excluded sectors. Which version survives will decide whether this is a mass-market form or a startup niche.
Can you file the application for me?
Not under the draft as it stands. Art. 13(2) requires the prospective directors to complete the application form themselves, identified by electronic identification means under eIDAS, and to sign it using trust services. The founding shareholders must sign the articles of association the same way. Those signatures are personal and cannot be delegated to us. What we can do is prepare everything — a complete, checked, translated data set and ready articles — so you complete the official process in one pass.
Will there be one single EU register?
Not in the current draft. Art. 1(b) and Art. 15 create an EU central interface built on the existing BRIS system, while registration itself stays with the national business registers. Startup groups are lobbying for a genuinely central register; the text does not provide one today.
Does an EU Inc let me pay tax somewhere cheaper?
No. Tax residence, permanent establishment, payroll, VAT and profit allocation rules continue to apply exactly as they do now, and employment protection follows where your staff actually work. The registered office determines which body of company law governs the company — not where you pay.
Do I need a tax number to form one?
No. Under Art. 20 the business register forwards your data automatically to the tax, social security and beneficial ownership authorities, and the tax identification number and VAT number are issued without a separate application. The number is a result of formation, not a prerequisite — which is why we do not ask you for one.
Why do you not collect my full details yet?
Because the official application form does not exist yet. Art. 13(3) leaves the actual field list to an implementing act that has not been adopted. Collecting your address, place of birth and tax IDs now would mean holding sensitive data with no settled purpose, which is exactly what data minimisation forbids — and it would make us a pointless target. We ask for the full set once the form is defined.
