Not an official service
This site is operated by a private company. It is not the European Commission, not a business register and not an official body. The EU Inc is a legislative proposal (COM(2026) 321) that is still being negotiated. No company can be formed through this site today, and nothing here creates a legal claim to a company name, a registration slot or a particular outcome. We help you prepare; the application itself must later be signed by the future directors personally using their electronic identity.
The German version of these texts prevails. Translations are provided for convenience.

Privacy
What we collect
For the waitlist: your email address, the intended country of registered office, the type of company you plan, your language, and optionally an intended company name. Nothing else. In particular we do not collect your address, date or place of birth, or any tax identification numbers.
This is not convenience. The official EU Inc application form does not exist yet — Art. 13(3) of draft regulation COM(2026) 321 leaves the actual field list to an implementing act that has not been adopted. Until the purpose is settled, collecting more would be incompatible with purpose limitation and data minimisation under Art. 5(1)(b) and (c) GDPR.
Legal basis
Consent under Art. 6(1)(a) GDPR, given via the checkbox in the form and confirmed through the link in the confirmation email (double opt-in). You can withdraw it at any time with effect for the future.
Trade mark check
When you check a company name, that name is sent to the European Union Intellectual Property Office (EUIPO) to be compared against the trade mark register. No personal data of yours is sent with it. Results are cached to keep the number of queries low.
Eligibility check
The eligibility check runs entirely in your browser. Headcount, turnover, age and business area are never transmitted to us and are not stored anywhere.

Retention
Confirmed waitlist entries are kept until you unsubscribe or the service is discontinued. Unconfirmed signups are deleted after 30 days. After an unsubscribe we retain the address only as far as needed to honour that unsubscribe.
Your rights
You have the right of access, rectification, erasure, restriction of processing, data portability and objection, and the right to lodge a complaint with a supervisory authority.

No EU Inc can be formed through this site, because the legal form does not exist yet. Joining the waitlist creates no claim to a company name, no registration slot and no priority over anyone else. Nobody is currently in a position to grant such priority.
Limits of the trade mark check
The trade mark check is an indication based on publicly available data. It does not replace a professional clearance search and does not guarantee that a register or a court will later accept the name.
